How independent contractors find engagements
Most 1099 engagements never reach a general job board. They move through three channels: companies that maintain a standing bench of contractors and re-engage them, referrals inside a trade or specialty, and marketplaces built specifically for contract work. General boards are dominated by W-2 postings, and their contract filters mostly surface staffing-agency roles that are W-2 in everything but name.
That matters for how you spend your time. A profile on a marketplace that employers search is worth more than volume applications to postings, because the hiring side of 1099 work is usually looking to fill a defined scope quickly rather than run a hiring process.
Practical checklist before you start applying:
- An EIN, so you are not handing your Social Security number to every client
- A W-9 filled out and ready to send
- General liability cover — many clients will not sign without a certificate
- A written scope template you can adapt, rather than signing whatever arrives
- A separate business bank account, which makes the tax year survivable
The terms worth negotiating
Rate is the obvious term and rarely the one that hurts. The terms that decide whether an engagement is worth taking are payment timing, scope definition, termination notice and exclusivity. Net-60 payment on a project with undefined scope is a worse deal than a lower rate at net-15 against a fixed deliverable.
Exclusivity clauses deserve particular attention, because they cut both ways. A clause forbidding you from serving other clients undermines your own contractor status — the same fact a tax agency would use to reclassify the engagement as employment — while removing the diversification that makes 1099 work survivable.
Tax: what changes when you go 1099
Self-employment tax is 15.3% — 12.4% for Social Security and 2.9% for Medicare — charged on 92.35% of net profit rather than on gross receipts. The Social Security half stops at the 2026 wage base of $184,500; Medicare has no ceiling. Half of what you pay is deductible against income tax, which softens the headline rate.
The IRS wants estimated payments four times a year — mid-April, mid-June, mid-September and mid-January — and charges an underpayment penalty when you miss them, even if you settle up in full at filing.
Deductible for most independent contractors:
- Mileage at the current IRS standard rate, or actual vehicle costs
- A home office used regularly and exclusively for the business
- Health insurance premiums, via the self-employed health insurance deduction
- Tools, equipment, software subscriptions and professional licences
- Continuing education and certification tied to your existing trade
1099 or employee: who decides
Calling an engagement 1099 does not make it 1099. The IRS looks at behavioural control, financial control and the nature of the relationship — who sets the hours, who supplies the tools, who carries the risk of loss, and whether the arrangement looks permanent.
Several states apply an ABC test that is materially stricter than the federal one, and can reach a different answer on the same facts. Misclassification is assessed against the hiring party, not the worker, but it disrupts both sides — back taxes, penalties and reclassified benefits.
